Apprentice note (§3.1.4.2.3): An apprentice not registered with a state apprenticeship agency must be paid the full determination rate for the classification of work performed.
Weekly Hours Entry
Enter straight (S) and overtime (O) hours per day. Rate = worker’s actual hourly cash wage. Gross = (S hours × Rate) + (O hours × Rate × 1.5). Fringe/hr = annual employer benefit cost ÷ 2,000 (form page 3 formula). Deduction fields (FICA, FED, STATE) are not computed — enter your computed withholding amounts.

Generate Sworn Payroll Report

Generates the official Delaware PAYROLL REPORT (DIA Office of Construction Industry Enforcement, form dated 5.05.2025) — four pages: contractor/employee blocks (pages 1–2), fringe benefits (page 3), Statement of Compliance (page 4).
Submit the completed, notarized PDF by email to [email protected].

The form must be notarized before submission (“Sworn to and subscribed before me, a notary public”). The signature and notary fields are left blank for wet signing. Civil penalty for failing to submit: $1,000–$5,000 per violation (29 Del. C. §6960(e)).

The fine is not the end of the scale. Delaware publishes a Prevailing Wage Debarment List for violations of §6960 and other State statutes: a debarred contractor may not bid on, be awarded, or receive any public construction contract in Delaware — and the Department names company owners individually, not just the company.
